Good News on Bank Charges – Make a Claim!
Although the Supreme Court has overturned rulings in the High Court and the Court of Appeal that Bank Charges were subject to fairness rules under the Unfair Terms in Consumer Contracts Regulation (UTCCR 1999) this is not the end of the road for bank charge claims.
This Judgement was specific to regulation 6 of the UTCCR (1999). It appears as if the OFT have focused on a weaker part of the Law.
Claiming Back Unfair Bank Charges In The UK
As part of this Judgement, Lord Phillips suggested to the Office of Fair Trading that they could look at the fairness by another route. This message was clear that they could look at these charges under Regulation 5 of the UTCCR (1999). The OFT may even refer the matter to the Competition Commission for a full investigation of bank charges on the UK consumer.
